TWO COUNTIES PREVAIL IN CIVIL RIGHTS LAWSUIT

ROOSEVELT COUNTY (KSEL) – Eddy and Roosevelt Counties have prevailed in a federal civil rights lawsuit filed by a former Roosevelt County employee. According to a statement released by a group called New Mexico Counties, the former employee claimed that his due process rights were violated by both counties as a result of an incident in which he was attacked by a jail inmate while on work release. The employee’s injuries were covered by workers’ compensation. However, the former employee argued that the counties’ policies were unconstitutional and contributed to the attack by the inmate. A federal judge ruled late last week in favor of the counties on all claims, thus ending the case that has been pending since 2014.
