ROOSEVELT COUNTY DETENTION CERTER SERVED TORT CLAIM
Eric Dixon announced that he has served a notice of tort claim on the Roosevelt County Clerk for the wrongful death of Eric Padilla who died while in custody of the Roosevelt County Detention Center on November 11th, 2021. Mr. Padilla was in custody from March 18, 2020 until November 11, 2020. Dixon is pursuing wrongful death, personal injury, defamation of character, and violation of Mr. Padilla’s property rights and/or deprivation of any rights, privileges or immunities secured by the constitution and laws of the United States or New Mexico.
Roosevelt County has since released a “press release” claiming Mr. Padilla “was found unresponsive in the County Detention Center” on November 11th, 2020 among other claims, this was a violation of his privacy.
