Clovis Attorney Dan Lindsey has been sued in the Curry County District Court for malpractice; breach of fiduciary duty; unfair practices; fraud; disgorgement; conversion and damages on December 22nd, 2020. The law-suit is the result of Lindsey’s representation of former client David Howl in a criminal proceeding. Mr. Howl paid Lindsey $40,000 to represent him but refused to given an accounting. Time for research was charged at $550 for research that was not done. An illegal fee agreement was prepared. Mr. Howl did not know that Lindsey employed a known embezzler as a “legal assistant.” Lindsey allowed Mr. Howl to enter into a plea agreement to a charge that does not exist under the law. A jury trial has been requested, but no jury date has been set at this point.
