PORTALES (KSEL)- Tuesday Afternoon, two of the most controversial bills of this 2020 Legislative Session will be debated for the first time in the Senate Public Affairs Committee (SPAC).
- Senate Bill 5 – Extreme Risk Firearm Protection Order Act
- Senate Bill 115 – Cannabis Regulation Act.
According to the Associated Press, Legislative elections and ideological divisions among Democrats are looming over major initiatives backed by Gov. Michelle Lujan Grisham from new gun restrictions to recreational marijuana legalization.
It seems the top issue for Roosevelt County as well as surrounding areas rotate around Senate Bill 5 or also know as the red flag gun law issue.
Supporters of red flag laws say they reduce gun violence, including suicides, and lessen the risk of mass shootings. Gun rights supporters contend they violate not only the right to own firearms but other constitutional guarantees, including the rights against unreasonable searches and seizures.
Roosevelt County Sheriff Malin Parker stated:
“We basically want to oppose this bill because it is not well written. It violates your 1st, 2nd and 4th amendment rights by denying your due process as well as taking out probable cause for illegal search and seizure. This bill is written and sponsored by people who really don’t understand that we already have laws in place that take care of this”.
New Mexico last year extended background-check requirements to nearly all private gun sales and prohibited firearms possession for people under permanent protective orders for domestic violence.
This Thursday Roosevelt Officials will be organizing a 2A Rally outside the Roosevelt County Courthouse in reference to Senate Bill 5.
After low attended rallies in Central New Mexico, Sheriff Parker stated that attendance is crucial to their cause.
“We want to send a message to Santa Fe that we will not sit back and be stripped of our rights.”
Officials from the Democratic Party of Roosevelt County released a statement commenting, that though it is in your right to exercise your 1st Amendment Right to freedom of speech, the Democratic Party of Roosevelt County has aligned with the governor when it comes to the red flag law.
Official Statement of the Democratic Party of Roosevelt County stated:
“With such a provision in place, it would secure our state and make it much safer by keeping weapons out of the hands of people such as the severely mentally ill and felons both of which should not have any possession of a firearm. Having such a law such as the red flag law is crucial to help ending the mass gun violence we see today. The notion that the red flag law is an avenue to taking guns out of the hands of all New Mexicans is categorically false and has absolutely no factual basis behind it.”
Leading Republicans in the House minority have vowed to protect gun rights during the upcoming legislative session.
